This Privacy Policy ("Policy") describes our practices regarding the use, disclosure, and protection of Personal Information collected by and on behalf of Hundred Public Safety, Inc., d/b/a Performance Protocol ("Performance Protocol," "we," "us," or "our") through our website www.performance-protocol.com and any other webpage, software, service, feature, product, program, and element that links to or references this Policy (collectively, the "Site"), when you register, access, interact with, or use our Services.

This Policy applies when Performance Protocol collects, uses, and shares your Personal Information for its own purposes through the Services. For example, this Policy covers when you:

  • Visit a Performance Protocol Site that links to this Policy, including when you are directed to it through job boards, social media sites, QR codes, or other referral sources;
  • Interact with the Services as a representative of an organization that has an account with Performance Protocol (i.e., you are our Business Customer);
  • Interact with our Services;
  • Provide us with feedback about our products or services; or
  • Interact with Performance Protocol, including via SMS messages, emails, or chatbot communications.

This Policy does not cover how we process personal or financial information on behalf of our business customers and business partners ("Business Customers") during our provision of services to them as a service provider. Performance Protocol is not responsible for the privacy or data security practices of our Business Customers, which may differ from those set forth in this Policy. Information we collect, receive, or process on behalf of our Business Customers is governed by our contractual agreements with them, and we only process such information in accordance with our Business Customer's instructions.

If you have questions or concerns about the Personal Information your organization holds in Performance Protocol about you, please direct your request to that organization and review such Business Customer's privacy policy, terms of use, and employment policies. Where Performance Protocol processes your Personal Information in the capacity of a service provider, we will provide you with the contact information of the Business Customer on whose behalf we collected and processed the Personal Information, so you can contact them directly.

This Policy does not apply to employees of Performance Protocol. This Policy incorporates our Terms of Use.

State Supplemental Privacy Notices

Colorado, Connecticut, Delaware, Iowa, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Tennessee, Texas, Utah, and Virginia Residents: If you are a resident of one of the states listed here, additional rights and terms may apply to you under the applicable State Supplemental Privacy Notice.

California Residents: If you are a California resident, additional rights and terms may apply to you under the California Privacy Rights Notice.

Modifications to This Policy

We may modify this Policy at any time. Material changes will be posted on the Site or otherwise communicated to you. We encourage you to periodically review this Policy for any changes.

What Is Personal Information?

The definition of "Personal Information" under applicable law (or similar terms like "personal data" or "personally identifiable information") varies based on where you live, but generally means information that identifies or can be used to identify an individual person.

1. Categories of Personal Information We Collect

We may collect Personal Information (a) that you provide directly to us, (b) automatically through your use of our Site and Services (e.g., via cookies), and (c) from third-party sources.

Personal Information You Provide to Us

You may visit our Site without providing Personal Information. However, if you choose to use certain functions on the Site or our Services, we may collect:

  • Identifiers and Contact Information: real name, date of birth, email address, zip code, postal address, phone number, online identifiers and usernames, profile photo, IP address, and other similar identifiers;
  • Employment and Professional Information: your resume and materials shared when you apply to a job, agency name, job title, location, screening responses (including US citizenship status, law enforcement experience, veteran status), employment history, and other professional background;
  • Communication Data: interactions with or through Performance Protocol, including third-party messaging services, telephone calls, SMS texts, emails, and notifications;
  • Internet Activity: browsing history, search history, page views, clicks, page leaves, and information regarding your interaction with a website, application, or advertisement; and
  • Technical and Device Data: information about your device, system, application software, and peripherals related to your interactions with our Site.

Accounts. We collect any information you provide when creating and using an account with us, which may be linked to your activity when you are signed in.

Feedback. When you provide comments or feedback about our Site or Services, we will not treat that feedback as confidential, and we may use it for any purpose contemplated by this Policy, without attribution or compensation to you.

Job Application, Employment Information, and Coaching. When you submit application materials or employment information, participate in our coaching programs, or communicate with a Business Customer through the Service, your information is submitted directly to us. We will use and disclose such information to the Business Customers with whom we have contracted or with your consent.

Business Contracts with Us. When a business contracts directly with us for our Services, we may collect Personal Information pursuant to the terms of that relationship, governed by the agreements between that business and Performance Protocol.

Personal Information We Collect Automatically

When you use our Site or Services, we may automatically collect certain information using tracking technologies such as analytics tools, web beacons, and pixel tags. These technologies allow the Site to remember your actions and preferences and recognize you or your browser.

What is the purpose of using cookies?

We use cookies to make our Site function properly, provide personalized experiences, tailor our interactions with you, gather data and statistics about the usage and effectiveness of our Site, and help us improve our services.

What type of information do cookies collect?

Tracking technologies may collect information such as IP addresses, your internet service provider, device ID, approximate geographic location, pages visited or clicked, the date and time of your visit, time spent, operating system, browser type, search requests, the websites you access before and after visiting, and data related to how and when you use the Services. We also collect server logs for security and operational purposes.

How long do cookies last?

Tracking technologies can be "session" based or "persistent." Session-based tracking exists only while you visit the Site and is typically deleted when you exit your browser. Persistent tracking exists for a set period and renews on each visit until its expiration date. You can manually delete persistent tracking through your browser settings.

How do you manage tracking technologies or opt out?

Most browsers automatically accept tracking technologies. You can disable this by changing your browser settings, but doing so may impact your use of the Site, and not all features may work properly. You cannot disable all tracking technologies, such as those essential to the functioning of the Site.

"Do-Not-Track" Requirement. We currently do not respond to "do not track" requests.

Analytics. We use analytics tools to collect and process information about your use of the Site. These tools may use local storage or similar technologies, and your browser automatically sends information to our analytics providers. You may opt out of certain analytics by adjusting your browser settings or contacting us directly.

Online Behavioral Advertising. We do not currently use third-party vendors to provide interest-based advertising services, and we do not serve advertisements customized based on predictions about your interests across different websites.

Third-Party Fonts and Services. We use Google Fonts on our Site, which may transmit your IP address to Google when fonts are loaded. Google may use this data in accordance with its own privacy practices.

Device Data. When you access our Service through a mobile device, we may collect unique identification numbers associated with your device (e.g., UDID, IDFA, Google Ad ID), mobile carrier, device type and model, operating system, phone number, and — depending on your device settings and explicit consent — geographic location data including GPS coordinates.

Consent Management

For certain types of Personal Information or specific uses, we may seek your explicit consent before collecting or using such information. This includes the use of your information for marketing purposes outside of the services provided to our Business Customers. You have the right to withdraw your consent at any time by:

  • Adjusting your device settings;
  • Updating your preferences in your account settings; or
  • Contacting us at info@performance-protocol.com.

Withdrawing consent will not affect the lawfulness of processing based on consent before its withdrawal.

2. Purpose for Collecting Personal Information

In addition to the uses described elsewhere in this Policy, we may collect, use, and disclose Personal Information for the following purposes:

As Stated or Agreed to at the Point of Collection. We use Personal Information for the purposes stated or agreed to at the point of collection — for example, to respond to your questions, comments, or complaints, to offer you our Services, to send your application information in response to a job posting, and to communicate with you about positions that may interest you.

Marketing Communications. If we receive your contact information, we may use it to send you information about other programs that may be of interest, as well as promotional and marketing communications. To opt out, please contact us as set forth below.

Managing the Job Application Process. We may use Personal Information to review, assess, recruit, and manage your job applications, including scheduling interviews, identifying your candidacy, providing your information to Business Customers, verifying information, communicating about positions, maintaining your information for future consideration, and satisfying legal obligations.

Administration, Site Management & Analytics. We use Personal Information to inform our business strategies, troubleshoot problems, improve content and functionality, perform statistical analyses, customize the Site, and assess the effectiveness of our services and market trends.

Communications. We may use Personal Information to notify you of new features, changes to our Terms or this Policy, and to request feedback.

Mobile Numbers & SMS. We will not share your mobile phone number with third parties for marketing or promotional purposes without your consent. By submitting your phone number, you authorize us to send you text messages and notifications. Message/data rates apply. Reply STOP to unsubscribe.

To Protect Our Rights. We may use Personal Information to protect our legal rights or interests, or those of other parties, to seek business, financial, or legal advice, and to respond to legal requests and regulatory obligations.

3. Disclosure of Personal Information

We may disclose Personal Information with the following categories of parties, in compliance with applicable laws:

  • Performance Protocol Customers — our Business Customers, with your consent.
  • Employees and Affiliates — who have a need to know the information for our business purposes.
  • Third Parties, Vendors, and Contractors — who process Personal Information on our behalf, including cloud infrastructure providers, SMS and email service providers, authentication and identity management providers, analytics providers, background check providers, and content delivery networks.
  • Change in Ownership — in connection with a sale, merger, reorganization, bankruptcy, or similar transaction.
  • Advisors — our attorneys, accountants, and financial and business advisors.
  • Legal/Governmental Authorities — when we believe in good faith we are legally required, when advised by counsel, or to protect legal rights.
  • Other — with third parties when explicitly requested by or consented to by you.

Social Media

We are active on social media such as Facebook, Facebook Messenger, Google, Twitter, Instagram, and LinkedIn. Anything you post on social media is public information and will not be treated confidentially; we may re-post such content on our Site, Services, and social media pages. Your use of social media platforms is governed by the applicable privacy policies and terms of those providers, not by this Policy. The Site may allow you to connect and share data with social media platforms, which may require cookies, plug-ins, and APIs provided by those platforms.

Children's Personal Information

The Site and Services are not directed at individuals under 18 years old. We do not knowingly collect, use, or disclose Personal Information from individuals under 18. If your child has provided us with their Personal Information, please contact us and we will make commercially reasonable attempts to delete it.

Data Security

We use commercially reasonable technical and organizational measures to help secure Personal Information against loss, misuse, and alteration appropriate to the type of Personal Information processed. Our security measures include encryption of data at rest and in transit, access controls and multi-tenant data isolation, role-based authorization, and multi-factor authentication. If a breach of your Personal Information occurs, we will notify you if required under applicable law.

NO DATA TRANSMISSION OVER THE INTERNET OR BETWEEN DEVICES CAN BE GUARANTEED TO BE 100% SECURE. WHILE WE STRIVE TO PROTECT PERSONAL INFORMATION, WE DO NOT GUARANTEE THE SECURITY OF PERSONAL INFORMATION, AND YOU PROVIDE PERSONAL INFORMATION AT YOUR OWN RISK.

Access From Outside the United States

If you access the Site from outside the United States, please be aware that Personal Information may be transferred to, stored in, and processed in the United States and in any other country in which Performance Protocol or its subsidiaries, affiliates, or service providers maintain facilities. Certain governmental authorities may not consider the level of protection of Personal Information in the United States to be equivalent to that required in other jurisdictions.

Third-Party Websites

The Site and Services may contain links to third-party websites that we do not operate or control. We do not assume responsibility for the activities of such third parties and are not responsible for their content, security, or privacy practices. We urge you to review the privacy policy posted on each website you visit prior to using the site or providing Personal Information.

Retention

We will keep Personal Information for the period necessary to fulfill the purposes described in this Policy, unless a longer retention period is permitted or required by law. We take reasonable steps to delete Personal Information when (i) we have a legal obligation to do so, (ii) we no longer have a purpose for retaining it, or (iii) you ask us to delete it — unless doing so would violate our existing legal, regulatory, dispute resolution, contractual, or similar obligations. We do not control Personal Information once it has been shared with a Business Customer; you may contact them directly to learn how they use and store your Personal Information.

Aggregate or De-Identified Information

We may process Personal Information to create aggregated, de-identified, or anonymized data so that the information cannot reasonably be used to infer information about, or be linked to, a particular individual. Any such data is no longer subject to this Policy. Once we have de-identified data, we will not attempt to re-identify it, and we will contractually obligate any recipients of the de-identified data to do the same.
